Michael S. Wilson is insurance regulatory and litigation counsel to statutory associations and other property and casualty carriers.

Representative Experience

  • Reporting to executive and senior management and board of directors of insurers on a full range of corporate, regulatory, legislative issues involving claims, underwriting, regulatory compliance, reinsurance and litigation.
  • Provided representation of statutory associations and other insurers before the Texas Department of Insurance on matters of regulatory oversight, compliance, enforcement proceedings, and administrative hearings. 
  • Provided advice and counsel on legislative affairs.
  • Acted as state-wide coordinating counsel for over 6,500 lawsuits, providing strategic guidance, management of defense, electronic discovery, and administration of client policies and directives.
  • Developed electronic discovery solutions for mass and serial litigation.
  • Provided advice and counsel on claims process, underwriting operations, agency relations, reinsurance, and coverage under first and third party insurance policies, including property, general liability, and professional liability coverages.
  • Drafted insurance policies, endorsements, and related forms, claims manuals, litigation guidelines, policyholder communications, and vendor agreements.
  • Liquidated a major statutory workers’ compensation insurer, including representation of the Special Deputy Receiver before the receivership court, regulatory compliance, wind-up of long-tail, retrospectively rated premium programs, collection of assets, claims advice and counsel, litigation management, and civil trials.
  • Represented insurers in litigation and trial of first party lawsuits, including allegations of “bad faith,” insurance code violations, and deceptive trade practices.
  • Class action defense, including storm surge and slab claims, general contractors overhead and profit, pricing, depreciation, and non-adhered shingles.
  • Enforcement actions, including prompt payment of claims, complaint recording, non-adhered shingles, general contractor overhead and profit, and storm surge and slab claims.
